Terms of Service

1. Service Description

ProductShot ("Service") is an AI-powered product photography platform operated by [TODO: COMPANY_DATA] (hereinafter "we", "us", or "Company").

The Service provides three modules:

  • Generate Photos — AI product photography from text and image prompts.
  • Creative Studio — advanced scene and lighting control for product images.
  • Mockup Generator — place products into realistic mockup scenes.

Images are generated using third-party AI models (OpenAI, Stability AI). We do not guarantee specific visual results — output quality depends on AI model capabilities, prompt quality, and source image quality.

2. Account Registration

  • You must provide a valid email address and verify it before using the Service.
  • You are responsible for maintaining the security of your account credentials.
  • You must be at least 16 years old to create an account.
  • One account per person. Creating multiple accounts is prohibited.
  • You may not resell, sublicense, redistribute, or commercially share access to the Service, your account, or purchased credits with third parties. Each account is for individual use only.

3. Credits & Pricing

The Service uses a credit-based system:

  • Credit packages are available at prices listed on our Pricing page. Current packages, prices, and credit amounts are displayed before purchase.
  • Credits are purchased as one-time packages through Stripe.
  • Each image generation consumes one or more credits depending on the AI provider, quality, and resolution selected.
  • Credits expire 12 months after purchase.
  • Credits are non-transferable between accounts.
  • Prices are displayed before purchase and include applicable taxes.

We reserve the right to modify pricing, credit packages, and credit consumption rates at any time. Changes to pricing or credit consumption do not affect previously purchased credits.

4. Refunds & Right of Withdrawal

As an EU consumer, you have the right to withdraw from a purchase within 14 days without giving a reason, in accordance with EU Directive 2011/83/EU.

Because the Service provides digital content, you will be asked to consent to the immediate provision of the service at checkout by checking the following box:

"I consent to the immediate provision of the digital service and acknowledge that I lose my right of withdrawal for the entire purchase once any credits are used."

By giving this consent and using any credits, you acknowledge that the digital service has begun and the right of withdrawal is lost for the entire purchase, in accordance with Article 16(m) of EU Directive 2011/83/EU.

  • Unused credits within 14 days (no consent given or no credits used): eligible for a full refund.
  • Any credits used after consent: not eligible for a refund — the right of withdrawal is lost for the entire purchase.
  • Failed generations: credits are automatically refunded to your account balance (not as a monetary refund).

If you initiate a chargeback or payment dispute through your bank or card issuer without first contacting us to resolve the issue, we reserve the right to immediately suspend or terminate your account. Fraudulent chargebacks may be reported to relevant authorities.

5. AI Disclaimer, Output Risks & EU AI Act Transparency

All images generated through the Service are created by artificial intelligence models. In accordance with the EU AI Act transparency obligations:

  • All output images are AI-generated content.
  • We do not guarantee that generated images will be free from artifacts, inaccuracies, or unintended content.
  • You are responsible for reviewing generated images before using them commercially.
  • We recommend disclosing AI generation where required by applicable law or platform policies.

AI-generated images may contain visual artifacts, inaccuracies, unintended brand logos, recognizable faces, or elements resembling copyrighted material. You are solely responsible for reviewing all generated content before any use — commercial or otherwise. We are not liable for any claims, damages, or legal actions arising from your use of generated images, including but not limited to intellectual property claims, defamation claims, or right of publicity claims.

6. Prohibited Use

You agree not to use the Service to:

  • Generate illegal, harmful, or misleading content.
  • Create deepfakes or deceptive imagery of real persons.
  • Generate child sexual abuse material (CSAM) or any content depicting minors in inappropriate contexts.
  • Infringe on third-party intellectual property rights.
  • Use automated tools (bots, scrapers) to access the Service without prior written consent.
  • Attempt to circumvent rate limits, security measures, or exploit the system.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service.

Violation of these rules may result in immediate account termination without refund.

We reserve the right to review, monitor, or analyze generated content to ensure compliance with these Terms and applicable law. We may remove content or restrict account access if we reasonably believe a violation has occurred.

7. Intellectual Property

  • Your content: You retain ownership of product descriptions and source images you provide, as well as the AI-generated images created from them. You may use them for any lawful commercial or personal purpose.
  • Our service: ProductShot retains all rights to the platform, branding, and underlying technology.
  • AI provider terms: AI-generated content may also be subject to the terms of the underlying providers (OpenAI, Stability AI). We recommend reviewing their usage policies.

8. Third-Party AI Providers

The Service relies on third-party AI providers (OpenAI, Stability AI, and others). We do not guarantee the availability, quality, continuity, or performance of any specific AI model or provider. Models may be changed, upgraded, downgraded, or replaced without notice.

9. Service Availability & Force Majeure

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without prior notice, including changes to AI providers, available models, and generation quality.

We are not liable for any failure or delay in performing our obligations caused by circumstances beyond our reasonable control, including but not limited to third-party service outages (Stripe, OpenAI, Stability AI, Cloudflare), internet disruptions, natural disasters, pandemics, government actions, or other force majeure events.

10. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any loss of revenue, loss of profits, loss of business, loss of data, loss of goodwill, or any indirect, incidental, special, or consequential damages arising from your use of the Service, even if we have been advised of the possibility of such damages. This limitation applies regardless of the legal theory on which the claim is based. Our total aggregate liability is limited to the amount you have paid for credits in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including liability for fraud or gross negligence).

12. Indemnification

You agree to indemnify, defend, and hold harmless the Company from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your use of AI-generated images, or (d) any third-party claims related to content you created using the Service.

13. Right to Refuse Service

We reserve the right to refuse service, suspend or terminate accounts, restrict access, or cancel transactions at our sole discretion, with or without cause and with or without prior notice.

14. Termination

  • You may delete your account at any time from the Settings page.
  • We may suspend or terminate your account if you violate these Terms.
  • Upon termination, your generated images will be deleted within a reasonable timeframe after account termination. Unused credits are not refunded upon voluntary account deletion after the 14-day withdrawal period.

We reserve the right to delete generated images and associated data from accounts that have been inactive for more than 12 months, after providing 30 days' email notice.

15. Complaints & Dispute Resolution

Before initiating any formal legal proceedings or regulatory complaints, you agree to first attempt to resolve the dispute by contacting us at contact@productshot.pro. We will make reasonable efforts to resolve the matter within 30 days of receiving your complaint.

We will respond within 14 days for consumer complaints as required by applicable EU law, and within a reasonable timeframe for all other inquiries.

If you are a consumer in the EU, you also have the right to use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Email Communications

Service communications (account verification, password resets, purchase confirmations) are sent via email. You are responsible for ensuring that emails from @productshot.pro are not blocked by your email provider or spam filters. We are not liable for missed communications due to email filtering.

17. Governing Law

These Terms are governed by the laws of the Republic of Poland. Any disputes shall be resolved by the competent courts in Poland. If you are a consumer in the EU, mandatory consumer protection laws of your country of residence continue to apply.

18. Changes to These Terms

We may modify these Terms at any time. Material changes will be communicated via email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and the Company regarding the use of the Service. They supersede all prior agreements, representations, and understandings.
